Main Functions(Profile):
The mission of the Ministry of Land and Resources as prescribed by the State Council is: to be responsible for the planning, administration, protection and rational utilization of such natural resources as land, mineral and marine resources in the People's Republic of China. Major functions and responsibilities assigned to the Ministry of Land and Resources by the State Council of the People's Republic of China are:
1. To enact relevant laws and regulations and promulgate rules governing the management of land, mineral and marine resources (with the exception of marine fishery resources managed by the Ministry of Agriculture, similarly hereinafter); to be responsible of administrative review in accordance with relevant regulations; to develop policies regarding the management , protection and rational utilization of land , mineral and marine resources; to formulate the technical criteria, rules, standards and measures for land ,mineral and marine resources;
2. To compile and implement the national comprehensive planning for land and resources , overall plan for land use and other specific plans; to participate in the examination and verification of city master plans submitted to the State Council for approval; to organize the survey and evaluation of mineral and marine resources; to develop plans for the protection and rational utilization of mineral and marine resources for the prevention and mitigation of geological hazards and for the protection of geological vestiges;
3. To supervise and inspect the law enforcement by departments responsible for land and resources management at various levels and the implementation of plans for land , mineral and marine resources; to protect the lawful rights and interests of the owners and users of land , mineral and marine resources , to undertake and organize the arbitration of major disputes over rights and ownership and investigation of major law-breaking cases;
4. To formulate policies for the special protection of cultivated land and encouragement of cultivated land development; to enforce the control over the purposes of agricultural land use; to organize the protection of capital farmland; to guide the unused land development, land treatment, land revitalization and reclamation so as to ensure the increase instead of decrease of cultivated land;
5. To formulate cadastral regulations, organize land and resources survey , cadastral survey , land statistics and dynamic monitoring; to administer land entitlement confirmation , land grading and registration;
6. To develop and implement the regulations for the assignment, lease, evaluation, transfer, transaction and governmental purchasing of land use rights; to work out catalogue guide for the allocation of land use rights for state-owned land and measures for land utilization by villages and townships, and to administer the transfer of the use right of non-agricultural land owned by rural collectives;
7. To administer the evaluation of land price (bench mark and standard land price), validate the qualification of the land evaluation and appraisal agencies, and confirm the land-use prices; to examine and submit applications for land use that require the approval of the State Council as prescribed by law;
8. To supervise the examination, approval, registration and licensing of the rights to explore and to mine the mineral resources and the transfer of the rights; to examine and approve area blocks for foreign cooperation; to undertake the management of mineral reserves and the collection and compilation of geological data; to administer, according to law , the geological exploration work , to examine and determine the qualifications of geological exploration organizations and manage results of geological exploration; to manage according to relevant provisions the collection and use of mineral resources compensations; to examine and validate the qualifications of the institutions responsible for the evaluation and examination of exploration rights and mining rights and confirm their evaluation and estimation results;
9. To organize the monitoring ,prevention and mitigation of geological hazards and the protection of sites of geological vestiges; to supervise according to law the hydro-geological, engineering geological explorations and evaluations to supervise the monitoring and prevention of the over-extraction and contamination of groundwater and protect geological environment; to designate geologically important areas for protection such as areas of valuable fossil origins and standard geological sections;
10. To arrange, supervise and inspect the use of the state funds for geological exploration and other related funds;
11. To organize international cooperation and exchanges in the field of land, mineral and marine resources;
12. To perform other duties assigned by the State Council;

To manage the State Oceanic Administration and the State Bureau of Surveying and Mapping in accordance with the relevant provisions of the State Council.

      To compile work plans for S&T and foreign affairs in respect of state land and resources, and supervise the implementation of major S&T projects and foreign affairs; to push forward the S&T progress and disseminate S&T achievements; to organize the cooperation and exchanges with foreign governments and international organizations, organize arrangements for foreign affairs and receptions and handling of formalities for personnel going abroad.</p>

  5. Department of Law Enforcement and Supervision

    • To organize the supervision and inspection of the implementation and abidance to state laws and regulations of land, mineral and marine resources, formulate rules for the supervision of the land law enforcement and the investigation and punishment of land law violations, organize the supervision and inspection of land planning, farmland application change, land requisition, land asset disposition and land use right transactions and organize investigation and punishment of major land law violations. </p>

      To implement the sector administration for geological explorations, be responsible for the qualification administration of geological exploration agencies; to master the overall situation of the geological and mineral explorations, organize the compilation of programs and plans for geological and mineral explorations; to be responsible for the review and approval of the applications for exploration rights and exploitation rights of petroleum oil, natural gas and coal-bed gas and supervise the exploration and exploitation of petroleum oil, natural gas and coal-bed gas.</p>

      To formulate administrative methods for geological vestiges and other geological resources and geological disasters; to organize the compilation and implementation of the programs for the prevention and treatment of geological disasters such as landslides, dilapidation, mudslides, land surface subsidence and cave-ins, and the protection of geological vestiges, and implement and inspect their implementation; to organize and coordinate the prevention and treatment of major geological disasters; to guide the monitoring, appraisal, and forecast of the geological disasters and the dynamics of underground waters; to organize the verification of origins of very valuable ancient fossils and standard geological cross-sections and other protection areas of geological vestiges, and organize geological vestiges protection and geological disaster prevention and treatment.</p>

      To organize the formulation of methods, standards, procedures and norms for the administration of the reserves of mineral resources; to administer the appraisal, registration and statistics of national reverse volume of mineral resources; to be responsible for the supervision and administration of national mineral mining rights; to undertake the collection of mineral resources compensation fees; to be responsible for the supervision and administration of the consolidation, keeping and utilization of national geological data; to organize the analysis of the supply and demand situation of mineral resources and formulate mineral resources policies.</p>

      To formulate administrative methods for land use right in respect of transfer, lease, value appraisal for capital contribution, transfer, transaction and government repurchase, formulate guidance catalogue of state-owned land allocations for use and administrative methods for township and village lands, and guide the administration of the land use rights circulation in respect of collective-owned non-agriculture land in the countryside; to guide the appraisal of the benchmark land price and marked land price, guide the review and verification of qualifications of appraisal agencies and confirm the price of land use rights.</p>

  10. Department of Minerals Exploitation Administration

      To undertake the acceptance and handling of review and examination of applications, as well as the registration and issuance of certificates, changes, continuance (retention), cancellation for mineral exploration rights and exploitation rights and their transfers, and other daily routines; to organize the compilation of deployment plans for national industrial mineral rights, and organize their implementation; to mediate major disputes and conflicts over exploration rights or exploitation rights; to organize the supervision and inspection of the exploitation, utilization and protection of mineral resources. </p>

      To formulate cadastral management methods, formulate technical norms and standards for land investigation, dynamic monitoring, cadastral investigation and statistics, organize investigations on the status land resources, dynamic monitoring, investigation of cadastral ownership, investigation and statistics on changes to cadastre; to formulate mediation procedures for disputes over land ownership certification, registration, certificate issuance and entitlement, as well as entitlement administration methods, and undertake the mediation of major land entitlement disputes. </p>

  12. Department of Farmland Protection

      To formulate policies for the special protection and encouragement of arable land development, policies for farmland protection and land treatment, administrative methods for farmland application transfers, formulate provisions for unused land development, land consolidation, land restoration and arable land development; to guide the control of farmland applications, organize the prime farmland protections.</p>

      To organize the formulation of related fiscal accounting rules, to supervise and administer the fiscal affairs and state-owned assets of the directly affiliated institutions; to undertake the administration of the land exploration expenses and other funds as allocated from state treasury; to conduct fiscal supervision and administration of various administrative and undertaking fee collections under the administration of the Ministry; to supervise the collection and utilization of mineral resources compensation fees.</p>

      To organize studies on the policies and measures on the comprehensive exploitation and treatment of state land in the country and key regions of the country, draft and compile national and regional programs for state land, overall programs for land utilization, programs for the protection and rational utilization of mineral and marine resources and programs of geological environment; to formulate land supply policies; to guide, review and verify primary land protection programs, land revitalization programs, land treatment programs, unused land development programs and other special programs and local land utilization master programs; to participate in the review and verification of city master plans submitted to the State Council for approval.</p>

      To study and formulate work plans, rules, detailed methods and administrative rules for the supervision of the state land, and be responsible for their implementation; to organize the studies on the improvement of state land supervision system and rules, formulate related policies and regulations and strengthen the building of rules; to guide, supervise and inspect the work of the state land supervision bureaus, urge them to implement comprehensively the responsibilities of supervision and inspection and promote the efficient conducting of the supervision and inspection; to be responsible for the consolidation and analysis of the issues of land law and regulation violations by the governments of provinces and special plan designated cities in state planning reported by the state land supervision bureaus and bring forward handling opinions and suggestions; to be responsible for the administration of orders for time-limit rectifications of land law and regulation violations; to be responsible for the administration of gathering, sorting, exchange, submission of important information on land supervision, strengthen the work of daily liaison, information communication and response of the state land supervision bureaus; to organize the individual state land supervision bureaus in conducting investigation and research on the administration of land resources, put forward policy suggestions for strengthening the land administration and promote the application and conversion of research achievements.</p>
